These Terms and Conditions (“Terms”) govern your use of credit cards arranged or facilitated by Bybit Technologies Limited (“Company”, “we”, “our”, or “us”) through its Partners. Please read these Terms carefully. By registering for or using the Services, you agree to be bound by these Terms.
1. INTRODUCTION
1.1 The Company facilitates the issuance of credit cards through its licensed third-party partners (“Partners”). Based on your eligibility, a card may be issued to you via one of the Partners.
1.2 You must maintain a fully funded account with the Company (“Bybit Wallet”) sufficient to cover any and all spending incurred via the credit card for its period of validity.
2. ELIGIBILITY AND REGISTRATION
2.1 We reserve the right at any time to:
(a) modify, update or change the terms and conditions of these Terms; or
(b) impose fees, charges or other conditions for use of the Service or parts thereof (with reasonable notice).
(all of the foregoing referred to as “Changes”).
2.2 We may make such Changes at any time without prior notice (except as noted in subsection (b) above). Any Changes to these Terms may be posted on our website or notified to you through an email to the email address in your Account. For this reason, you should check our website regularly, allow the receipt of such push notifications, and keep your email address and other contact information up to date in the Account. You accept any Changes if you continue to use the Services after such Changes are effected.
2.3 You must:

(a) Be of legal age and have capacity to contract under applicable laws.

(b) Reside in a jurisdiction eligible for card issuance as determined by the Company and its Partners.

(c) Comply with all applicable laws, including anti-money laundering (AML) and know-your-customer (KYC) requirements.

(d) Provide all verification and identification documentation as required by the Company or its Partners.
2.4 You agree to keep your registration information accurate and up to date. Failure to do so may result in suspension or termination of your access to the Services.
2.5 The Company reserves the right to modify, suspend, or terminate your access to the Services at any time, at its sole discretion.
3. CREDIT LIMIT AND REPAYMENT
3.1 The credit limit of the card issued to you shall be determined solely by the Partner and may be adjusted at its discretion.
3.2 You hereby authorize the Company to freeze and deduct the necessary amount of virtual assets from your Bybit Wallet to settle any outstanding credit card transactions. This authorization remains valid after card expiry for transactions approved during the validity period. All card-related balances must be settled immediately upon becoming due. In the event that there is insufficient funds in your Bybit Wallet to cover any outstanding amounts, we reserve the right to suspend or terminate your access to the Services without prior notice. The suspension will remain in effect until all outstanding balances, including any applicable fees or charges are fully repaid.
3.3 Refunds processed to your credit card will be returned to your Bybit Wallet within two (2) working days of receipt by the Partner.
4. FEES
4.1 The Company may charge the following fees:

Crypto Conversion Fee: 0.9%

Card Issuance Fee: Free for virtual cards; physical card fees quoted based on delivery location

ATM Withdrawal Fee: First USD 100 per calendar month is free; 2% thereafter

Foreign Currency Conversion Fee: 2%

Monthly Maintenance Fee: None
4.2 The Company may revise fees from time to time. Updated fees will be published on the Platform.
4.3 Third-party charges (e.g., ATM operator fees) may apply and are your responsibility.
5. TRANSACTION LIMITS
5.1 Regardless of your credit limit, transaction limits based on your verification level apply as follows:

5.2 The Company may revise transaction limits or your assigned level at any time at its sole discretion.
6. TRANSACTION PROCESSING AND SECURITY
6.1 You are solely responsible for maintaining the confidentiality and security of your card, card credentials, login credentials, authentication codes, and any other information used to access or authorize transactions through the Services. The Company shall not be liable for any loss, damages, or unauthorized transactions resulting from your failure to safeguard your credentials or from any third-party access caused by negligence, misuse, or compromise of your devices, passwords, or card details.
6.2 You must report unauthorized transactions immediately. Disputes must be submitted within thirty (30) days of transaction posting.
6.3 The Company is not liable for failed, declined, or delayed transactions due to technical, regulatory, or external factors.
6.4 Chargeback requests are subject to review and may require supporting documents.
6.5 The card must not be used for unlawful or prohibited purposes. We may terminate services if illegal activity is suspected.
7. SUSPENSION AND TERMINATION
7.1 We may suspend or terminate your access to the Services at any time, with or without prior notice, if we reasonably determine that:

such action is required to comply with applicable laws, regulations, or regulatory guidance;

you are, or are suspected of being, engaged in any fraudulent, unlawful, or suspicious activity;
-
we receive a request or directive from any of our Partners; or
-
you have breached any provision of these Terms or any applicable policies.
7.2 You may terminate use of the Services by contacting us and completing all required closure procedures.
7.3 In the event that your card is suspended, limited, restricted, deactivated or terminated, we are in no way obliged to honour or reinstate a transaction or price on the same terms had the suspension, limitation, restriction, deactivation or termination not occurred.
8. INDEMNITY
8.1 To the maximum extent permitted by law, You agree to indemnify, defend and hold harmless the Company (and each of its associated entities, directors, officers, affiliates, employees, service providers, members, representatives and agents, collectively the “Indemnified Parties”) from and against all claims, demands, actions, suits, proceedings, liabilities, losses, damages, penalties, fines, expenses and costs (including reasonable legal costs awarded by a court) which arise out of or relate to:

Your conduct and use of our Services;

Your breach of these Terms and/or our anti-money laundering and counter-terrorism financing (“AML/CTF”) policy;

Your breach of any law, regulation or rule;
-
Your violation or breach of the Company's copyright, intellectual property, trade secrets, patents, trademarks, service marks or any other proprietary right under law;
-
Your failure to secure or keep secret your card credentials or any other authentication data under Clause 6.1;
-
any information that you provide to us via our Services;
-
any damage that you may cause to our Services, to any user or any other person or entity; or
-
any right exercised by the Company under these Terms.
8.2 This indemnity includes without limitation, liability relating to intellectual property rights, defamation and breaches of privacy.
9. LIMITATION OF LIABILITY
9.1 To the maximum extent permitted by law, the Company does not guarantee the quality, performance or fitness for purpose of the Services or the completeness, accuracy or currency of statements, representations and information of others (including without limitation data, reports and analyses) provided via the Services and the Company will not be liable to you, any person or entity for any direct, indirect, incidental, consequential or other loss, damage, liability, claim or expense (however caused, including due to negligence or breach of contract) which may arise out of, or in connection with, the use of the Services or the use of or reliance on information contained on or linked to the Services.
9.2 We are not liable in any way when an authorization is declined for any particular transaction regardless of the reason.
9.3 We accept no responsibility or liability for the goods or services that you purchase with your card or for any product or service discounts arising from the purchase with your card.
9.4 We accept no responsibility or liability for a merchant refusing to accept your card or failing to cancel an authorization.
9.5 We do not provide any warranty in relation to your use of the Services To the extent permitted by law, all conditions or warranties implied by law, statute or otherwise are expressly excluded.
9.6 You agree to use the Services at your sole risk and on an “as is” basis.
10. GOVERNING LAW AND DISPUTE RESOLUTION
10.1 These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law principles.
10.2 If you are a consumer and have a complaint, we encourage you to first contact our support team at support@bybit.com.
10.3 If the complaint is not resolved to your satisfaction, you may refer the matter to the Singapore International Mediation Centre (SIMC) for mediation, followed by arbitration at the Singapore International Arbitration Centre (SIAC) in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (“SIAC Rules”) for the time being in force, which rules are deemed to be incorporated by reference in this clause if mediation fails.
10.4 The language of arbitration shall be English. The seat of arbitration shall be Singapore. Each party shall bear its own costs unless otherwise decided by the tribunal.
11. GENERAL
11.1 The Company reserves the right to update these Terms at any time. Continued use of the Services constitutes your acceptance of the updated Terms.
11.2 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
11.3 These Terms constitute the entire agreement between you and the Company regarding the Services.
11.4 By using the Services, you accept that it is your responsibility to determine whether and to what extent, any taxes apply to any transactions or trades you conduct through our Services. It is also your responsibility to seek professional tax advice with respect to the card as well as to ensure that you are compliant and that the Services satisfy Your requirements. The Company does not provide any advice or take any responsibility for information that you receive through our Services.
11.5 If we are unable to perform our Services as stipulated in these Terms due to circumstances out of our control, including but not limited to, change of law, regulations or policy, or an event of force majeure, we will not be held liable.
11.6 Any failure or delay to enforce a term or exercise any right or remedy under these Terms by us shall not be construed as a waiver of that right or remedy or preclude its exercise at any subsequent time.
